EB-5 investment strategy
EB-5 offers standalone and regional-center investment paths. We help clients understand the immigration requirements, legal documents, potential conflicts, and available protections before investing or filing a petition.
Compare EB-5 investment optionsA standalone business generally relies on direct job creation and closer operational involvement. A regional-center offering can pool capital and support qualifying direct and indirect job creation.
Review the project-side record, current I-956F status, construction assumptions, capital stack, job cushion, fees, extension authority, and exit.
Align source-of-funds evidence, investor eligibility, offering and transaction documents, filing sequence, reporting, and the evidence required through Form I-829.
EB-5 immigrant investor program
The EB-5 immigrant investor program offers eligible investors, their spouses, and unmarried children under 21 a pathway to permanent residence through a qualifying investment in a U.S. commercial enterprise that supports the required job creation.
Currently $800,000 for a targeted-employment-area or infrastructure investment; $1,050,000 for other qualifying investments.
The investment generally must support at least 10 qualifying full-time jobs for U.S. workers.
One qualifying investment may include the principal investor, a spouse, and unmarried children under 21.
The EB-5 process begins with two years of conditional residence, followed by an opportunity to remove the conditions after the program’s requirements are met.
After maintaining permanent-resident status and meeting separate naturalization requirements, eligible investors and family members may later apply for U.S. citizenship.
EB-5 planning update · October 2026
September 30, 2026 was the statutory filing date tied to protection if the Regional Center Program later lapses – not the date EB-5 closed. The program remains authorized, and USCIS continues to accept new investor petitions.
For investors beginning now, January 1, 2027 is the next major investment-planning date. Congress directed the minimum investment amounts to adjust for inflation then, while the official figures remain subject to a DHS technical amendment. Filing before the adjustment can preserve the current investment threshold – but only if the petition is properly filed and received.

“Pavel is the most knowledgeable, approachable and trustworthy immigration attorney I ever met.”Yang Zheng · EB-5 investor
“Words can’t express my gratitude for all the work Pavel did on my behalf. I actually consulted with several immigration attorneys about my Mandamus Case and most of them have dissentient thoughts and asking me to just wait. While Pavel is a very knowledgeable and responsible lawyer, very patient provides prompt responses to the tons of questions I have, and always points out professional views which brings me a big confidence. USCIS requested future evidence for my case and he always followed up on the status during the document preparation and gave guidance. I would DEFINITELY recommend Pavel to every EB-5 investor who has problems or if your case is taking too long. Good luck!”Lesley Chen · EB-5 investor
